In general your letter noted the following:
Item 1 – A breach in the retention berm, which needs to be corrected in 30 days (12/10/08) from receipt of the letter.
Item 2 - This relates to storm water runoff, infiltration and an annual inspection of the 100 linear-feet of drain field (Reference Permit 42-061-40167-1).
Item 3 - This covers rear lot swales It states that the Homeowners Association is responsible to ensure these retention areas remain clear of debris, excess fill or structures that could potentially block the flow of storm water runoff and reduce the retention volume.

Our follow up response to your letter is as follows.
Item 1 - The attached photo is the picture of the mound of dirt, which has filled the breach. By next week 12/17/08 we should have the sod over the dirt.
Item 2 - This was closed out by the attachment to our first email.
Item 3 - We understand it is our responsibility to spread the word in the subdivision and we do. Note - The owner of the structure shown in your picture has removed numerous railroad ties. I noticed them on his front yard last week. I have not spoken with David Hayes so I am not aware of what agreements were made between the parties, but action is being taken. I left a message on David’s answering machine but we have not connected as of yet.

In response to your questions:
1. The type of soil/fill is not really that important for the repair of the breach. If you were replacing soils in the bottom of the retention pond, I’d recommend clean sands (with good drainage characteristics); however, the breach is not really required to have clean sandy soils. Any soils—other than clays or muck—is fine. Once you have placed down the soil, it is recommended that you sod the areas as soon as possible.

St. Johns River Water Management District site inspection
A letter( included with photos)dated 11/10/08 sent from St. Johns River Water Management District, stated they did a site inspection of our subdivision in response to concerns associated with the stormwater management system as Indian River County recently notified the district of numerous concerns. The included data is for your information. The empasis is related to the 25-foot rear lot swales, and encrochments, to said swales, on the north and south side of the entire subdivision. As a result they have identified 3 specific items that need to be addressed and want us to notify them of our plans in writing in a timely manner.
Item 1 - This needs to be corrected in 30 days from receipt of the letter and then notify the District. It pertains to a breach in the retention berm which looks like an easy fix.

I received a letter from Kay Clem, Supervisor of Elections, about the Early Voting dates and locations for the local residents in Indian River.
This election is a historical event and we (the citizens) will be voting in mass. It's going to be a BIG one. So I recommend that we take the opportunity to get it done EARLY.

Keeping an Eye Out
I know the NEWS is talking about Hurricane IKE and I know most of you know, as I see the Hurricane Panels, Shutters and other window treatments up and down our street.
Please also note that the areas on both sides of the community entrance at the mailbox area were recently weeded and cleaned up.
Also note that its seems someone took a liking to our recently planted "Snow on the Mountain" and removed these plantings from our corner at 10th and 6 Ave. So...please keep and eye out for your property as well as that of others.

Bill Calculator
Thanks to Glenn Heran who is preparing a bill calculator for four of the six types of jurisdictional/service provider calculations that are needed to compare electric bills in the County, City, and Shores where electric service is provided by either the City or FPL. You will be able to enter the Kilowatt Hours (KWH) used from your current bill into the format appropriate for the jurisdiction and/or service provider and get the cost including taxes, etc. This will give you the ability to compare your costs as though you had a different service provider and/or lived in a different jurisdiction. It will show true comparability, not the biased comparisons from the City.
When Glenn completes this, it will be put on the website. What is needed for to complete the final calculations are a couple of volunteers from the Shores with City electric and with FPL electric to provide a couple of recent electric bills to Glenn so he can complete the calculation schedules. Email - If you are reading this then you have an email address that I know about and thus you are getting this note. We have 52 homeowners and I have 20 email addresses. I would like all 52 so I can just post them to this blog and when it gets updated you get a system note automatically,to come see whats been posted.
The auto system notification is not turned on yet. My understanding is that when I add the email list I have to the blog and check a box then it will happen. So send me your email and talk to your neighbor and see if they know about the blog. If they don't clue them in and see if the would like to participate.
BLOGSPOT - There is a feature inside the software that allows for this to be a private place, public place or a semiprivate place. In other words only available for viewing by the residents. At the moment it is available to the general public for viewing, as I checked that button, when I generated this blogspot, because its easier for me. The Board - Board President, Ms. Elaine Florence, called the meeting, held at the Rock Ridge Community Center, to order at 10:30 today, July 26, 2008. Board members present Mr. Dick Byram, Mr. Bob Scully and Mrs. Jean Kay.
General - The minutes summarize items addressed and actions taken by the board at the meeting. Topics Addressed
1 - Association Finances presented by Jean Kay
a. CDs valued at $86,766. One matured in July. The other will mature August.
b. Checkbook value $ 13480.90 as of 7/26/08
c. Total assets 100, 246.
2 - Monthly association dues delinquencies.
Three letters were sent out to those who owe, just as a reminder. Some homeowners have paid for the year in advance. Thank You.
3 - Association Liability Insurance
It was noted that we carry $2,000,000 coverage at a cost of $600.
4 - Landscaping
A team was established at the meeting to work this issue. A plan, with some detail needs to be outlined to spruce up the Entrance Garden next to the mail box and on the corner at 6th and 10th .

5 - Neighborhood Watch
There was a home burglary over the past week. Please be aware that these are difficult times and we encourage you to lock doors and windows and close garages. Get to know your neighbor and watch out for people who may be acting suspicious in the neighborhood.

There is still an issue about physical property lines and encroachments related to patios and fences in relationship to home sales.
7 - Special Thank you
Thank You Gaylord Hansen for all your hard work over the past several years as an active member on the Catalina Oak Homeowners Association.
8 - New Board Member
Dick spoke with John Cone who has accepted the open post of the board.
9 - Record Retention
Gaylord is looking to pass on the association records. Dick and Bob will get with him to understand what exactly he has. After we have an understanding of what needs to be saved and how far back we must go we will come up with a plan.

The above noted blogspot is something started a few months ago. It is intended to provide a record of the minutes and other data related to Catalina Oaks for those who are interested and are not able to attend the quarterly meetings. It can be changed and will continue to evolve.

Although these were not discussed at our 7/26/08 meeting they were addressed at the 4/26/08 meeting and are considered significant so they are listed for your information.
· Association Governing Documents – Improvements and modifications - All members must abide by the association governing documents when it comes to improvements and modifications to homes in the community. If you decide to make a change to the paint color of your house, add a new roof, etc., the information must be presented to the Architectural Review Board (Dick Byram) for approval prior to any work starting.
· Home Sales - It was noted that some NEW homeowners in the community had not received any information about the Catalina Oaks Deed Restrictions at the time of sale. Individuals who are selling or plan to sell their house must provide a package (Deed Restrictions) to the real estate agent and new potential buyers prior to the home sale. This package is available from the board. If this package is not provided prior to the home selling the buyer may be able to cancel the contract without penalty at anytime.
· HOA Officers 2008 – It was noted that the board must file the 2008 Catalina Oaks Board members with the Secretary of State of Florida. Elaine will get with Jean to see if that has been done.
· As the board continues to use unlicensed and uninsured workers what is the homeowner’s liability in the event of a suit (ref. item 3). Gaylord will respond.

My back surgery was scheduled for August 11 when they called with a cancellation for July 10th. Which gave me little time to obtain the exray, two mri, ekg and consent from my primary Doctor. Been to busy to even think of an agenda for the July 26th meeting. I am having three herniated disks cleaned up and hopefully that will cure most of my pain from the back and down both legs. Catalina Oaks Homeowners Association Board of Directors
The minutes summarize items addressed and actions taken by the board at the meeting. If you would like more detail please contact any member of the board and consider attending the next meeting. Ten homeowners attended this meeting.
Board President, Ms. Elaine Florence, called the meeting, held at the Rock Ridge Community Center, to order at 10:00. Additional board members present Mr. Gaylord Hansen, Mr. Dick Byram and Mr. Bob Scully. Not in attendance were Mrs. Jean Kay and Mrs. Shirley Spitzer.
Elaine mentioned that Mrs. Shirley Spitzer has resigned from the board and then she read the meeting minutes from the 1-12-2008 meeting. Prior to doing so she requested that all comments and questions be held until the board agenda, dated 4/26/2008, was covered.
The agenda had 14 items that were discussed during the meeting. Items 4, 5 and 9 were tabled because Jean was not in attendance and they were her specific items to address. Elaine will get with Jean to get the data to close out those line items.
Item # 1 - Dick is working at odd jobs around Catalina Oaks and that is fine as long as the board members agree.
Item # 2 - Two members of the board must sign off on all association business.
Item # 3 - Association Liability Insurance – It was noted that an association like ours should have at least $2,000,000 coverage, as a minimum. A comment was made suggesting it would be better to have $5,000,000, depending on what the association could afford. A question was raised about the homeowner liability if the association insurance was inadequate and did not cover a potential claim. Gaylord will have further discussion with legal on the subject, as the board could not answer the question at the meeting.

Item # 7 - Common Ground Maintenance - Dick will coordinate this action with Eddie and get him to continue with the once a week cleanup in Catalina Oaks for $450 a month.
Item # 8 - High Electric Bills – Gaylord mentioned that there was some press recently that may impact the high electric bills we are getting.
Item # 9 - HOA Officers 2008 – It was noted that the board must file the 2008 Catalina Oaks Board members with the Secretary of State of Florida. Elaine will get with Jean to see if that has been done.
Item # 10 - DuHaime Wood Structure – The structure is on county property.
Item # 11 - Wall Extension – Consideration was being given to continuing the fence along the south and east property line. Cost input was obtained. A chain link fence was estimated at $6000. A styrofoam look-a-like wall that would mimic the existing cinderblock wall would cost $60,000. Gaylord noted that a chain link fence is not acceptable per the bylaws. The cost of extending the wall is not justified and no further action is being considered.
Item # 12 - Solar Light Switches – Dick will replace the switches for the light fixtures at the entrance of the community (southwest corner at 6th Avenue).
Item # 13 - Parking on the Grass – The grassy area next to the mailboxes is being used for parking by some while getting mail, which is killing the grass and causing ruts. Bob will place NO Parking signs to see if that will eliminate the problem. It was also mentioned that some residents park on the street next to the mail box, which impedes traffic flow, and some leave the car door open while they get mail. These are potential accidents and should be avoided for your safety as well as those who are coming and going.
Item # 14 - Standing Water (Southside of lot 11) – Not sure what can be done but Gaylord will look into this further.
The “Deed Restricted” sign needs attention, some road repair work is needed to the asphalt and the entry garden needs some care. Dick will coordinate this activity and get with Uta, who expressed and interest in sprucing up the Entrance Garden.

Catalina Oaks Homeowners Association Board of Directors
The minutes summarize items addressed and actions taken by the board at the meeting. If you would like more detail please contact any member of the board and consider attending the next meeting. Ten homeowners attended this meeting.
Board President, Ms. Elaine Florence, called the meeting, held at the Rock Ridge Community Center, to order at 10:00. Additional board members present Mr. Gaylord Hansen, Mr. Dick Byram and Mr. Bob Scully. Not in attendance were Mrs. Jean Kay and Mrs. Shirley Spitzer.
Elaine mentioned that Mrs. Shirley Spitzer has resigned from the board and then she read the meeting minutes from the 1-12-2008 meeting. Prior to doing so she requested that all comments and questions be held until the board agenda, dated 4/26/2008, was covered.
The agenda had 14 items that were discussed during the meeting. Items 4, 5 and 9 were tabled because Jean was not in attendance and they were her specific items to address. Elaine will get with Jean to get the data to close out those line items.
Item # 1 - Dick is working at odd jobs around Catalina Oaks and that is fine as long as the board members agree.
Item # 2 - Two members of the board must sign off on all association business.
Item # 3 - Association Liability Insurance – It was noted that an association like ours should have at least $2,000,000 coverage, as a minimum. A comment was made suggesting it would be better to have $5,000,000, depending on what the association could afford. A question was raised about the homeowner liability if the association insurance was inadequate and did not cover a potential claim. Gaylord will have further discussion with legal on the subject, as the board could not answer the question at the meeting.
Item # 4 - Association Finances – Tabled

Item # 6 - Association Governing Documents – Improvements and modifications - All members must abide by the association governing documents when it comes to improvements and modifications to homes in the community. If you decide to make a change to the paint color of your house, add a new roof, etc., the information must be presented to the Architectural Review Board for approval prior to any work starting.
Home Sales - It was noted that some NEW homeowners in the community had not received any information about the Catalina Oaks Deed Restrictions at the time of sale. Individuals who are selling or plan to sell their house must provide a package (Deed Restrictions) to the real estate agent and new potential buyers prior to the home sale. This package is available from Gaylord. If this package is not provided the buyer may be able to cancel the contract without penalty at anytime.
Item # 7 - Common Ground Maintenance - Dick will coordinate this action with Eddie and get him to continue with the once a week cleanup in Catalina Oaks for $450 a month.
Item # 8 - High Electric Bills – Gaylord mentioned that there was some press recently that may impact the high electric bills we are getting.
Item # 9 - HOA Officers 2008 – It was noted that the board must file the 2008 Catalina Oaks Board members with the Secretary of State of Florida. Elaine will get with Jean to see if that has been done.
Item # 10 - DuHaime Wood Structure – The structure is on county property.
Item # 11 - Wall Extension – Consideration was being given to continuing the fence along the south and east property line. Cost input was obtained. A chain link fence was estimated at $6000. A styrofoam look-a-like wall that would mimic the existing cinderblock wall would cost $60,000. Gaylord noted that a chain link fence is not acceptable per the bylaws. The cost of extending the wall is not justified and no further action is being considered.
Item # 12 - Solar Light Switches – Dick will replace the switches for the light fixtures at the entrance of the community (southwest corner at 6th Avenue).
Item # 13 - Parking on the Grass – The grassy area next to the mailboxes is being used for parking by some while getting mail, which is killing the grass and causing ruts. Bob will place NO Parking signs to see if that will eliminate the problem. It was also mentioned that some residents park on the street next to the mail box, which impedes traffic flow, and some leave the car door open while they get mail. These are potential accidents and should be avoided for your safety as well as those who are coming and going.
Item # 14 - Standing Water (Southside of lot 11) – Not sure what can be done but Gaylord will look into this further.
The “Deed Restricted” sign needs attention, some road repair work is needed to the asphalt and the entry garden needs some care. Dick will coordinate this activity and get with Uta, who expressed and interest in sprucing up the Entrance Garden.

Annual meeting of Catalina Oaks Home Owners’ Association called to order Saturday January 12, 2008 at 10:30 by the President, Elaine Geyer.
1. Attendees: 30 residents present (attendees and proxies). Proxies submitted by Gaylord.
2. Old Business - Minutes of last meeting sent to all residents in the mail. Discussed at the meeting and No exceptions. Approved by the attendees.
3. Accounting summary provided by Jean Cay
· Expenses - $13,881.00 versus income $19,090.00.
· In the bank - $82,000.00 in a Certificate of Deposit and $6,156.00 in the bank account as of 01/12/2008
4. Gaylord presented statutes of Federal Housing Authority changes that affect our community. New form relative to “DEED restrictions” for residents Re: Sales of Home needs to be signed by buyers. Anyone selling a home needs to provide the buyer with this new form available from Gaylord at the beginning of the escrow process. If not the buyer may be able to cancel contract at no cost or penalty to him/her.
5. The proposed budget for 2008 was mailed out to the residents. There were No acceptations at the meeting. The budget was approved.
6. Question: What was the cost of painting the wall, inside and out? Answer - $4,000.00 both sides.
7. Question: Gerry Duhaime asked about sidewalk repair. Do we need to fix it or is it county issue. Gerry to inquire of county about repairs to sidewalk and handle this matter. No action for HOA.

New Business and discussions
1. 2008 Board Members - The existing board indicated they would stand and will continue their roles. Robert Scully was elected to the board at the meeting.
2. Board Members 2008 - Dick Byram, Bob Scully, Elaine Florence Geyer, Gaylord Hansen, Jean Kay and Shirley Spitzer.
3. Road repair: It was suggested at one of the prior meeting that we have the road repaved at 10th Place and 5th Court. An estimate was provided. The cost was $48,000.00 so the board stated we would put that action on hold.
4. Storm Water System: The drains were cleaned out late 2007. It was recommended that in the future the drains are dry before we have them cleaned out.
5. Maintenance:
(A) Pond area needs more attention
(B) Spruce up entrance to Catalina Oaks. Elaine will coordinate with residents who wish to participate.
6. April meeting – Residents with issues or concerns should submit said items in writing prior to next meeting so they can be put on the Agenda.
7. Pets –
(A) There have been Large Dogs seen in the community. Letters have been sent regarding the deed restrictions for pets.
(B) Reminder – You must clean up after your pet. There seems to be “Lack of Compliance” especially at the mailbox.
(C) Pet Committee – It was suggested that a Pet Committee be formed. This group would be responsible to register resident pets so we know who owns what animals. Elaine will ask legal if this c-an be done.
